Article 1: RESERVATION OF SKIING MATERIAL

1-1: RENTAL COSTS

The rental costs are calculated on the basis of our applicable rates and are acskifcording to the category of equipment reserved, as well as to the rental period. For reservations effectuated via the internet, the discount is automatically calculated according to the rental period. The discount is only applicable for reservations made at least 7 days before the initial rental period.

 

Our prices include value added tax at the current prevailing rate at the time of your reservation.

1-2: PAYMENT OPTIONS

 

A: SECURE PAYMENT BY CREDIT CARD

Val Sports has entered into a service agreement with the ‘Banque Populaire’ for electronic business ; this agreement is called «Cyberplus Payment».

This agreement aims to ensure all necessary features to manage a merchant service and to securely acquire payments over the Internet.

 

The ‘Banque Populaire’ handles trade security and ensures secret data protection (deciphering keys) and management.

For the rented equipment, the client can pay directly online via credit card (Visa, Eurocard or Mastercard).

In order to do so, the client should indicate the credit card number (16 digits), the expiry date and the 3 digit CVV (Card Verification Value) code on the back of your credit card.

Only credit/debit cards issued in France and within the international networks approved by GIE Cartes Bancaires are accepted.

Financial costs (bank charges in connection with the exchange rate, banking commission for payment transactions made outside the territory where the card was issued, and other banking commissions) that may be tied to payments by credit card will remain the customers’ responsibility.

Once validated by the customer on our Website, the order will be placed, subject to the acceptance of the central bank card network. In the event of a refusal from the central bank card network, we will cancel the order.

When making payment, customers are automatically connected to the payment processing centre’s server. Data, protected by encryption, do not transit through the system of VAL SPORTS and are therefore not stored by us in anyway.

 

B: BANK CHEQUE PAYMENT

VAL SPORTS accepts bank cheque payments for the hiring of equipment (payable in France only) or giro cheques for all reservations booked more than 5 days before the first day of rental.

The cheque shall be drawn up in euros, to the order of:

If the cheque is not received at least 5 days before the customer’s start date, the payment for equipment rental must be made solely by bank card. If payment is not made by bank card, the reservation will be cancelled.

 

C: HOLIDAY CHEQUE PAYMENT

VAL SPORTS accepts French holiday cheque payments (ANCV) for the hiring of equipment or giro cheques for all reservations booked more than 5 days before the first day of rental.

VAL SPORTS recommends customers to send a holiday cheque for an amount lesser than or equal to the amount of the reservation, if needed supplemented by a bank or giro cheque. If the amount of the holiday cheque is higher than the reservation, VAL SPORTS will not be able to give change to the hirer.

If the “Chèque Vacances” is not received at least 5 days before the customer’s scheduled equipment pick-up, the payment for equipment rental must be made solely by bank card. If payment is not made by bank card, the reservation will be cancelled.

1-3: FINAL ORDER

An order is considered final when payment in full is received by VAL SPORTS in accordance with the above procedures and an electronic confirmation with an attached voucher is issued to the customer. Customer is required to print and present the voucher to the VAL SPORTS store.

Article 2: MAKING AVAILABLE AND RETURNING THE RENTAL EQUIPMENT – RENTAL PERIOD

The rental period starts once the client collects the material in our store and expires upon return of the material at the dates as mentioned on the voucher. The client should bring this voucher to VAL SPORTS in order to collect the rental equipment.

The equipment can be collected the day before the first day of the rental period after 4 PM and returned at the end of the last day of the rental period or on the following morning before 10 AM.

Any return of equipment made after 10 AM on the following day of the planned return date on the voucher will entail the billing by VAL SPORTS of one day of rental at the prices shown in our store.

The rented winter sport equipment becomes the full responsibility of the customers as soon as collected by them. The customer shall ensure its conservation and shall make use of it with due care at all times. Taking possession of the rented equipments remains the responsibility of the customer.

In case of late collection of the rented equipments, the customer shall inform VAL SPORTS as soon as possible. We will keep the booked equipment at the customer’s disposal for 24 hours. Passed this time, the equipments shall be made available for renting again, without compensation to the customer.

The rented equipments shall be returned to the VAL SPORTS store where they were collected. Failure to return the rented equipment – regardless of the reason – will result in VAL SPORTS billing the customer for the full value of the equipment at its public price as new, in addition -to the cost of the rental.

While making the reservation on the internet, the client has the possibility to insure against any theft (please see under guarantee / article 4)

Article 3: USE OF THE HIRED EQUIPMENT

The rental equipment is for the customer’s personal use only. No possibility of subletting or lending even gratuitous use by other is permitted.

The customers are the sole judge of their ability to use the rented equipment.

The customer attests to be able to use the rented equipment and pledges to use it cautiously, at no risk for third parties in accordance to the regulations in force.

All rental equipment is in good condition and shall be returned as such. The equipment being numbered or marked shall be returned with the same numbers and the same mark. Any damage – regardless of the cause – will require direct payment to VAL SPORTS for the repair or replacement cost of up to the rental price of new equipment , in addition to the cost of hire.

While making the reservation on the internet, the client has the possibility to insure against any damage (please see under guarantee / article 5)

 

Article 4: GUARANTEE

For internet reservations, we propose a specific guarantee which will provide you with an additional flexibility with reference to the skiing material rented via internet.

When making your reservation, you have the option to subscribe to this particular guarantee. Which will be applicable for the entire time you rent your skiing material.

The price is in accordance to the reserved rental category (either individual or package):

1 EUR a day for a pair of skies or a snowboard for adults and 0.50 EUR a day for a pair of skies or a snowboard junior. Please note that this guarantee is not applicable on other products.

In case the material is lost, stolen or damaged, the guarantee will partially or totally refund the equipment. However, you will no longer benefit from the discount granted via internet.

Article 5: CANCELLATION POLICY

The customer has 7- days from the booking confirmation to cancel the reservation. If this period were to end on a Saturday, Sunday or on a bank or public holiday, it shall be extended to the next working day.

This cancellation right does not apply where the reservation is booked 7 days or less from to the scheduled pick-up.

 

5-1: EXERCISING THE WITHDRAWAL RIGHT

In case of exercise of the withdrawal right within the 7-day cancellation period, the sums paid by the customer shall be refunded less an administrative charge of 1€ per person including taxes. The refund is made whether by crediting the card used for the transaction ; or by bank cheque if the customer paid by bank cheque or holiday cheque.

 

5-2: CANCELLATION OR MODIFICATION BEFORE COLLECTING THE SKIING MATERIAL AND AFTER THE WITHDRAWAL RIGHT PERIOD

Maximum 2 days before the initial rental period, you can cancel the entire reservation or part of the reservation. You will be fully reimbursed or reimbursed pro-rata and the relative guarantee will be paid pack.

Less than two days before the initial rental period:

– if you have subscribed to the guarantee when making your reservation online: you can still modify your reservation, but you will no longer

benefit from the discount granted via internet. Should you cancel your reservation, you will be fully reimbursed.

– if you did not subscribe to the guarantee when making your reservation online: you will not be able to cancel nor to modify your reservation.

 

5-3: CANCELLATION OR MODIFICATION AFTER COLLECTING THE SKIING MATERIAL

– Reservation with guarantee:

You can return the rented material before the end of the rental period. In that case, you will be charged pro-rata according to the number of days you have rented the equipment and according to the prices as applicable in the store. The guarantee will not be reimbursed.

You can switch to equipment from another category (upgrade in category for example). For any change in the category of equipment you will either need to pay a supplement (in case of an increase in categorie) either you will be reimbursed for the difference (decrease in categorie). However, in both cases you will no longer benefit from the discount granted via internet.

 

A refund will be made whether by crediting the card used for the transaction; or by bank cheque if the hirer paid by bank or holiday cheque. Partial days will not be refunded.

 

– Reservation without guarantee: you will not be able to cancel nor to modify your reservation.

 

5-4: CANCELLATION DUE TO WEATHER CONDITIONS

In case of full closure of the ski area normally accessible from the place of equipment rental and due to bad weather conditions only, the involved days of rental will be refunded upon presentation of a supporting document issued by the resort’s ski lift company.

In this case, the refund will be made whether by crediting the card used for the transaction ; or by bank cheque if the hirer paid by bank cheque or holiday cheque.

 

Article 6: PERSONAL DATA

According to the French law 78.17 ‘Loi Informatique et Liberté’ dated the 6th of January 1978, article 34: the client has a right to access, change, correct or delete his personal data. You can exercise your right by writing a letter to the following address:

Article 7: APPLICABLE JURISDICTION

In case of a dispute arising out of or relating to this agreement, and failure to an out-of-court settlement, the dispute shall be resolved by the competent Court.

The competent Court is Annecy, France, which is the place where you have rented your material.
